Meru High court judge Justice Edward Murithi has issued orders to extend suspension of the hospitals mentioned in the NHIF heist saga for another 7 days.This is after health Cabinet Secretary Susan Nakhumicha ordered for the closure.
On Friday 23rd, Jakim Hospital Nkubu Limited, the 1st petitioner and Jekim Medical Centre the 2nd petitioner through their lawyer Mbaabu went to court to sue three respondents: Kenya Medical Practitioners and Dentist Council, health Cabinet Secretary Susan Nakhumicha and the Attorney General for closing down the facilities without due process.
The 1st respondent, Kenya Medical Practitioners and Dentist Council was not represented in the court despite the petitioners saying he served them with a copy of the affidavit of service and stamped.
However, Wachira Nguyo who represented the state council of the 2nd and 3rd respondents while appearing virtually said the matter is fairly urgent and sought an adjournment to allow him to seek instructions saying he received the affidavit a few days before the hearing and he is yet to obtain instructions from his clients.
“Mr Mbaaabu we can’t appear to be extending orders through so if there is a date which is available early, we allow the Attorney General to respond in three days and we give you a further three days to file any supplementary if necessary”, said Justice Murithi.
The hearings or any further directions will be heard on July 6th 2023 at 9 am.
